These Terms of Service ("Terms") form a binding agreement between you and The Revenue Catalyst, owned and operated by Danielle Bowman ("we," "us," or "our"), and govern your access to and use of www.therevcat.com, our courses, coaching, community (The Lion's Den), digital products, and any related services (collectively, the "Services").
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a binding contract under applicable law. If you are using the Services on behalf of a company, you represent that you have authority to bind that company.
You are responsible for the accuracy of your registration information and for all activity under your account. Keep your password confidential. Notify us immediately of any unauthorized use.
Digital courses and downloads: Due to the nature of digital products, all sales are final unless a written refund window is stated on the specific product page at the time of purchase.
Coaching: Booked 1:1 sessions may be rescheduled with at least 24 hours' notice. Sessions cancelled with less notice or missed ("no-shows") are non-refundable.
The Lion's Den (subscription): You may cancel at any time from your account. Cancellation stops future charges; previously charged periods are not refunded.
Chargebacks: Initiating a chargeback in violation of these Terms is a breach of contract and we reserve the right to recover the disputed amount plus reasonable costs.
Subject to your payment and ongoing compliance, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal or internal business use. You may not:
To keep the community safe and high-signal, you agree not to: harass, threaten, or discriminate; share confidential deal information that is not yours to share; post spam or unauthorized promotions; impersonate others; share or sell member contact information. We may remove content or suspend access at our discretion.
All content on the Site and in the Services (text, graphics, logos, scripts, frameworks, course materials, recordings, software) is owned by or licensed to The Revenue Catalyst and is protected by U.S. and international intellectual property laws. "The Revenue Catalyst," "TheRevCat," and our logos are trademarks of Danielle Bowman.
By submitting testimonials, posts, comments, or other content, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display that content in connection with the Services and our marketing. You represent that you own the rights to submit such content.
We share strategies, frameworks, and information based on Danielle Bowman's experience. We do not guarantee specific revenue, sales, income, or business results. The Services may rely on or link to third-party tools (e.g., Stripe, Calendly, Go High Level, YouTube, Zoom). Your use of those tools is governed by their own terms and privacy policies.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE REVENUE CATALYST OR DANIELLE BOWMAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless The Revenue Catalyst, Danielle Bowman, and our affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms.
We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms. Provisions that by their nature should survive termination will survive (including IP, disclaimers, limitations of liability, indemnification, and dispute resolution).
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute not subject to arbitration.
Informal resolution: Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration & class waiver: Any dispute that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and we waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing us within 30 days of first agreeing to these Terms.
We may update these Terms from time to time. Material changes will be posted on the Site with a new "Last updated" date. Continued use of the Services after changes constitutes acceptance.
These Terms are the entire agreement between you and us regarding the Services. If any provision is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may.
